TERMS AND CONDITIONS AGREEMENT
This Terms and Conditions Agreement (“Agreement”) is entered into by and between Safe Sitters Europe LLC, a Wyoming limited liability company (“SSE,” “Company,” “we,” or “us”), and any individual or entity accessing or using the Platform (“User,” “you,” “Family,” or “Sitter”).
Safe Sitters Europe is a curated childcare platform designed to support traveling families in securing trusted, flexible childcare across Europe. We take a thoughtful and hands-on approach to connecting families with experienced sitters, while maintaining a structure that allows for direct relationships between families and caregivers.
By accessing or using the Platform, you agree to be bound by this Agreement.
I. NATURE OF SERVICES
1. Platform Role
SSE operates an online referral and booking platform designed to connect families seeking short-term childcare services with independent childcare providers (“Sitters”).
We provide referral, coordination, and administrative support services to facilitate a seamless booking experience.
For clarity, SSE does not:
• Provide childcare services directly
• Employ sitters
• Act as a traditional staffing agency
• Supervise sitter services
• Guarantee placement outcomes
• Enter into childcare contracts on behalf of users
All childcare services are provided solely by Sitters under a direct agreement between the Family and the Sitter.
II. INDEPENDENT SERVICE PROVIDERS
Sitters using the Platform operate as independent service providers.
Nothing in this Agreement shall be interpreted to create:
• Employment
• Partnership
• Joint venture
• Agency
• Franchise
• Representative authority
Sitters:
• Set their own rates
• Control their availability
• Accept or decline bookings at their discretion
• Provide services independently
• Determine how services are performed
SSE does not supervise or control the performance of childcare services.
Sitters remain solely responsible for compliance with:
• Local tax laws
• Social security contributions
• Licensing requirements
• Applicable legal obligations within their jurisdiction
III. PLATFORM FEES
1. Booking Fee
Safe Sitters Europe charges Families a €50 booking fee per booking, per calendar day.
This fee supports:
• Personalized sitter matching
• Thoughtful vetting and interview review
• Administrative coordination and scheduling
• Ongoing communication and booking support
The €50 fee is earned upon submission of a booking request.
2. Circumvention
To protect the integrity of the platform, Users agree not to bypass or circumvent SSE.
If a Family engages or hires a Sitter introduced through the Platform outside of SSE within twelve (12) months of introduction, SSE reserves the right to:
• Charge applicable booking fees
• Suspend or restrict account access
IV. PAYMENTS
1. Platform Payment
Payments to Safe Sitters Europe are processed via Wise or other designated payment methods.
2. Sitter Payment
All sitters operate as independent contractors.
Families are responsible for paying sitters directly for their time and services.
We strongly encourage families to:
• Confirm hourly rates in advance
• Align on payment method
• Discuss expectations prior to the booking
This ensures clarity and a smooth experience for all parties.
3. Chargebacks
Improper or fraudulent chargebacks constitute a material breach of this Agreement.
SSE reserves the right to:
• Suspend accounts
• Recover associated fees
• Pursue recovery costs, including reasonable attorney fees
V. CANCELLATIONS & CHANGES
Booking fees are non-refundable, except in the event that:
• A sitter cancels
and
• SSE is unable to provide a replacement
In such cases, 50% of the booking fee for the affected day will be refunded.
Sitters may cancel due to emergency circumstances but are expected to notify both the Family and SSE promptly.
2. Families may request changes to an existing booking, including adjustments to dates or times, with adequate notice.
• Requests made 5+ days in advance will be accommodated whenever possible, based on sitter availability
• Requests made with less than 5 days’ notice may not be accommodated and may require a new booking fee
All changes are subject to sitter availability and confirmation.
VI. BACKGROUND CHECKS AND SCREENING
Sitters engaged through Safe Sitters Europe may provide documentation, including:
• Background checks
• Certifications
• Professional references
SSE takes a thoughtful and thorough approach to reviewing all submitted materials, including assessing documentation for completeness, consistency, and alignment with our standards.
However, while we strive to maintain a high level of quality and professionalism, SSE does not guarantee:
• Absolute accuracy of documentation
• Authenticity of records
• Ongoing validity beyond the time of review
• The scope or comprehensiveness of background screenings
Families are encouraged to conduct any additional independent vetting they deem appropriate.
SSE operates as a referral platform and shall not be held liable for any errors or omissions in documentation provided by sitters.
VII. USER RESPONSIBILITIES
Families agree to:
• Provide a safe and respectful environment
• Accurately communicate job expectations
• Pay agreed-upon compensation
• Comply with applicable laws
Sitters agree to:
• Accurately represent qualifications
• Conduct themselves professionally
• Comply with applicable laws
VIII. LIMITED ROLE AND NO GUARANTEE
While SSE is committed to providing a high-quality experience, we do not guarantee:
• Sitter performance
• Compatibility between parties
• Safety outcomes
• Availability of sitters
• Continuous platform access
All services are provided on an “AS IS” basis.
IX. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
SSE’s total liability shall not exceed the total platform fees paid to SSE by the User in the preceding three (3) months.
SSE shall not be liable for:
• Personal injury
• Property damage
• Theft
• Emotional distress
• Indirect or consequential damages
• Loss of income
X. RELEASE AND INDEMNIFICATION
Users agree to release SSE from any claims arising out of:
• Sitter services
• Interactions between users
• Booking arrangements
• Disputes between parties
Users further agree to indemnify and defend SSE from any claims, including reasonable attorney fees, arising from:
• User conduct
• Breach of this Agreement
• Negligence or willful misconduct
XI. ACCOUNT SUSPENSION
SSE reserves the right to suspend or terminate accounts for:
• Fraud
• Abuse or harassment
• Chargebacks
• Circumvention of the platform
• Violations of this Agreement
XII. CONFIDENTIALITY AND NON-DISPARAGEMENT
Users agree not to make false, misleading, or defamatory statements regarding SSE or other users.
XIII. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Wyoming, United States.
Nothing in this Agreement limits any mandatory consumer protections under applicable EU law.
XIV. DISPUTE RESOLUTION
Parties agree to attempt informal resolution prior to initiating legal proceedings.
Venue and jurisdiction shall be determined in accordance with applicable law.
XV. SEVERABILITY
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
